Terms of Use
These Terms of Use ("Terms") apply to texaslicenseprep.com and the practice exams, questions, explanations and other materials on it (the "Service"), operated by Texas License Prep ("we," "us," "our"). By using the Service or making a purchase, you agree to these Terms.
1. About the Service
Texas License Prep offers original practice questions, timed practice exams and study tools for Texas occupational license exams.
- We are an independent study resource and are not affiliated with, endorsed by, or connected to the Texas Department of Licensing and Regulation (TDLR), PSI Services LLC, the Railroad Commission of Texas, or any other agency or testing vendor.
- Our questions are written by us from publicly available exam outlines, statutes, rules and reference materials. They are not actual exam questions.
- The Service does not count toward any education, licensing or registration requirement.
2. Eligibility
You must be at least 18 years old to purchase access, or have the permission of a parent or legal guardian who agrees to these Terms.
3. Educational content disclaimer
The Service is a study aid, provided for educational purposes only. Your use of the Service and its content is entirely at your own risk.
- No guarantee of results. We work to keep content accurate and current, but laws, rules and exams change and errors can occur. We do not guarantee that you will pass any exam or obtain any license or registration, and practice scores do not predict your actual exam score.
- Not professional advice. Nothing on the Service is legal, tax, appraisal, accounting or other professional advice, and it should not be relied on for any real-world matter.
- Official sources control. Explanations name the statutes, rules and references they are based on so you can verify them yourself. The official versions published by the State of Texas and the licensing agency always control. We do not host or link to outside materials and are not responsible for any outside website or document.
- Your responsibility. You are responsible for how you prepare, for confirming current requirements with the licensing agency and testing vendor, and for any decisions you make.
4. Purchases and access
- Purchases are processed by our reseller and merchant of record, Lemon Squeezy, which handles payment, sales tax and receipts, and is also subject to Lemon Squeezy's terms.
- After purchase you receive an access key. Access lasts for the period stated at purchase (currently 12 months).
- Your access is a personal, non-transferable license for your own individual study, not a sale of the content.
- Each access key may be used on a limited number of devices (currently 3), and daily usage limits may apply.
- Prices may change at any time; changes do not affect purchases already made.
5. Refunds
All sales are final. See our Refund Policy for the limited exceptions.
6. Acceptable use
You agree not to:
- Share, sell or transfer your access key, or let others use your access.
- Copy, scrape, reproduce, distribute, upload or resell any questions, answers, explanations or other content, including to Quizlet, Stuvia, Course Hero, Scribd or similar sites.
- Use bots, scripts or other automated means to access the Service.
- Bypass or interfere with access controls, device or usage limits, or the Service's security.
- Use the Service unlawfully or in violation of any agency's or testing vendor's rules.
7. Intellectual property
All questions, explanations, page content, design and software on the Service are owned by Texas License Prep and protected by copyright. Statutes and rules remain public law; our questions and explanations about them are our original work. Third-party works we reference belong to their owners.
8. Corrections and changes
We may update, correct, add or remove content and features at any time, including to reflect changes in law or exam outlines. If you spot something that looks wrong or out of date, email [email protected] with the question text and we'll review it.
9. Termination
We may suspend or end access, without refund, if we reasonably believe these Terms have been violated. We may also suspend the Service for maintenance or reasons outside our control.
10. Disclaimer of warranties
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, CURRENTNESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT ANY CONTENT REFLECTS THE CURRENT EXAM, LAW OR RULES.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL TEXAS LICENSE PREP OR ITS OWNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, EXAM OR APPLICATION FEES, RETESTING COSTS OR LICENSING DELAYS, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR ACCESS.
12. Indemnification
You agree to indemnify and hold harmless Texas License Prep and its owners from any losses, liabilities and expenses (including reasonable attorney's fees) arising from your misuse of the Service or your violation of these Terms.
13. Governing law
These Terms are governed by the laws of the State of Texas.
14. General
These Terms, the Privacy Policy and the Refund Policy are the entire agreement between you and us regarding the Service. If any part is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not transfer your rights under these Terms. Sections 3, 6, 7 and 10 through 13 continue to apply after your access ends.
15. Changes to these Terms
We may update these Terms by posting a new version with a new effective date. Continued use after an update means you accept the updated Terms.
